I David Chisholm of the State of South Carolina and County of Union, being weak and low in Body, but of Perfect mind and memory; make this my last will and Testament,
… First, I desire to be buryed in a Christian like manner, and after my Funeral expences are paid.
The remainder of my Temporal Estate I bequeath and dispose of in the following manner (To Wit):
… I desire that all my just debts to be paid.

Whereas Elijah Dawkins hath applied to me for Letters of Administration on all singular the goods and chattels, rights and credits of Adam Chisholm late of the district aforesaid, deceased.
These are therefore to cite and admonish all and singular, the kindred and creditors of the said deceased, to be and appear before me, at our next Ordinary’s Court for the said District, to be holden at Union Court House on the 1st Monday of November next to shew cause, if any, why the said administration should not be granted.

The 1820 US Census shows Delilah Chisom as head of household in Laurens County, South Carolina. Her husband John Chism was not deceased – he apparently must have been in Alabama preparing to move his family.
The Census shows she has 2 male children under 10 years of age, 2 female children under 10 years of age, and 1 female child between the age of 16-25. With their oldest child being 16 years of age, she is likely at least 30-37 years old at the time of the 1820 US Census – placing her year of birth about 1783-1790.

And your orators further shew unto your honors that John Smith the complainant and husband of your oratrix is unfortunately for him either entirely insolvent or nearly so and they are poor and bu a slender means of procuring a support and that the whole of the rest of the fortune of your oratrix which she received from her father’s estate has past into and through the hands of her husband the said John Smith and that he has not as yet made any settlement by any Estate on your oratrix.
The complainants therefore pray that the said land may be partitioned and divided and the share of the said Nancy the complainant settled on her to the use of herself and husband for the — and that the defts may account for rents and profits of the said lands and that the defts may answer this … and that a writ of subpoena issued …. may issue directed the said Defendants William B. Nott and Elizabeth Farnandes and so such other and further relief … compts case may be given and as in duty bound the bill ever pass.

… these Defendants state that in time that Adam Chisholm died many years ago having the four children enumerated in the will … the Defendant did not know whether he died intestated.
The Defendant Wm B Nott says that his father ___ Nott, under whom he claims, as he is informed bought ___ of the land which he supposes the complts refer to, from the late Henry Farnandis and the Defendant Elizabeth Farnandis states that her late husband, the said Henry, having purchased, claimed the whole of the tract while he held the whole & the half after he divided with Judge Nott, adversely to the claim of the complainants.
The Defendants plead that they and them under whom they claim have had an adverse and ___ possession of the land, example the complainants claims for about ? and claim the complt of the statute of limitations.
The Defendant Wm B Nott states that he is informed by his father, that some years before he bought any part of the land, and while John Chisholme lived on it, he (John Chisholm) offered to sell it to him and showed him a deed which his father Adam Chisholm had made him of it.
And the Defendant Farnandis states, that in the division of her husbands estate, that part of the land in question which he retained was assigned to their daughter Catherine Farnandis now the wife of Jos L Lines as whose guardian Deft held it until her ward attained majority. The condition of the above obligations … above bound John Chism has sold unto the said Emery W Rogers one undivided half of Lots numberd 60, 65, 94, and 95 lying and being in North Tuscaloosa the two first named lots being front on which my Tavern stands and the two last named being back lots on which the stables etc belonging to the Tavern stands with the improvements etc for the sum of — thousand dollars and the said John Chism has also … unto the said Rogers runiture belonging to the said Tavern to the amount of 500 dollars making in all 4500 dollars 2000 of … is paid in hand and the remaining 2500 dollars to be paid in two equal installments the first of which is payable on the 25 day of December next and the remaining half the 25 day of December 1838.

1847 – According to the 1987 Chism Family Monograph, a Mrs. Lillian Mann of Aberdeen, Mississippi, a descendant of John Chism and Delilah, shared an old family bible. One of the family pages had been torn out but the following entries were found on the second page:

JOHN CHISM OF LAURENS COUNTY, SC IS NOT “BLIND” JOHN CHISUM, NOR IS HE HIS SON.
(Note: The John Chism of Lauren County, SC is not “Blind” John Chisum. “Blind” John Chisum was living in Rutherford County, North Carolina from at least 1799 until he moved to Tennessee in 1807. The following records show that “Blind” John Chisum was the one living in Rutherford County, NC – the 1804 deed shows Jonathan Harris and William Riddle as witnesses – John Chisum Jr had married Jonathan Harris’ daughter (Mary Harris), and William Riddle had married “Blind” John Chisum’s daughter. The 1800 US Census shows that this “John Chisholm” was born prior to 1755 – too old to be John Chisum Jr. The 1807 deed shows that one of the John Chisums (Jr or Sr) had moved to Tennessee. The 1809 and 1810 deeds show Gatewood Chisum (son of “Blind” John Chisum), William Riddle, and William Fisher who married another of “Blind” John Chisum’s daughters involved in the transactions in Rutherford County, NC. 1816 tax records show that “Blind” John Chisum is living in Madison County, Alabama – where he dies in 1829 – and his probate paperwork is found. All this shows that the John Chism living in Lauren County, SC cannot be “Blind” John Chisum).
Summary: 1) “Blind” John Chisum’s son, John Chisum Jr, was married to a Mary Harris – not Delilah. 2) “Blind” John Chisum and his son John Chisum Jr were both living in Rutherford County, NC by 1804 when John Sr conveyed land to John Jr. 3) John Jr has moved to Jefferson County, TN by 1807 when he conveys his land in Spartanburg Co, SC to a John Amos. 4) John Sr moves to Madison Co, AL by 1816 according to Alabama Tax records – so neither can be the John Chism that continues to live in Laurens Co, SC and Union Co, SC records from 1816-1824.
1799 Nov 23 – John Chisim was issued 100 acres of land on 23 Nov 1801 in Rutherford County, NC located “On both sides of North Fork of Pacolet River … on a walnut James Logans old corner … with a line of a 50 acre tract granted to Foster … “. This was recorded in Land Patent Book 111 page 407 as Rutherford County Grant # 2124. The original request for this land was entered on 24 Jul 1799 and assigned Rutherford County Entry # 1608. It took 2 years and 4 months to issue the grant.
