Several documents identify this particular John Smith as the John Smith of Thicketty Creek and Guilkey Creek in Union Co, SC – which is where Abraham Smith lived at the time of his death.  In particular:

John Smith’s spouse is named “Nancy” as shown in transactions in and around Thicketty Creek and Guilkey Creek in Union Co, SC. Some prior researchers incorrectly identified John’s wife as “Ann” based on transactions involving the Langstons – but those transactions were between a John Smith and his mother named Ann who is the widow of William Smith, decd (citation: bk I, p 15 Union Co, SC. https://www.familysearch.org/ark:/61903/3:1:3Q9M-CSKJ-QVNT?i=26&cat=340217 (This transaction clearly identifies Ann as the mother of John Smith (and others) and widow of William Smith – so this is not the correct John Smith).

John Smith’s wife is identified as Nancy Chisholm, daughter of Adam Chisholm in the following transaction:

Apparently, the executors of Adam Chisholm decd’s estate had never released her portion of her inheritance from her father. The estate paperwork identifies Nancy Chisholm’s brothers in the accounting of the estate. See:

In 1829 John Smith and wife Nancy file suit for an partition and division of land that was part of Adam Chisholm decd’s estate at his death – see:

The above lawsuit was abated in 1834 as John Smith and wife Nancy have moved to Alabama in the fall of 1833 where the rest of the Smith family had previously moved. See:

John Smith and Nancy Chisholm Smith did not appear to have a large number of children. Despite the large number of “John Smiths” in Union Co, SC and York Co, SC, their 1810 US Census is identified.  In this 1810 US Census John Smith 26-44 years old, has a wife the same age, and has 2 daughters under the age of 10. His Census listing is two listings away from his mother Mary Smith (1 female over 45 yrs of age, 1 male 26-44, 2 males 16-25, 1 female 10-15) and adjacent to Thomas Jefferies, and on the same page as Joseph Moorehead, Joseph Guiton (Guyton)(over 45 yrs of age – so his grandfather), Margaret Guiton (Guyton), Amos Davis (4 males 16-25, 1 female 16-25, 3 females under 10), Abram Guiton, John Humphrey (his brother in law)(1 male and 1 female 26-44, 1 male 16-25, 2 males under 10), John Guiton, Isaac Guiton, another Joseph Guiton (1 male and 1 female 26-44, 4 males under 10, 2 females under 10), and Nathaniel Guiton. These are all relatives (mother, uncles and aunts, brother in law, and cousins) and many of these people are listed on his land transactions – confirming this is the correct John Smith.  See:

In the 1820 US Census in Union County, SC, John Smith is listed adjacent to John Jefferies Jr and two listings from William Moorhead – neighbors of his on Thicketty Creek and Guilkey Creek area that show up in records and transactions in that area.  In the 1820 US Census John Smith and Nancy are both listed as 26-44 years of age and have 1 female living with them aged 16-25.  The other daughter that showed up on the 1810 US Census has likely either married or has died.  See:

Combining both the 1810 and 1820 US Census puts both John Smith and Nancy Chisholm Smith’s year of birth somewhere between 1776-1784.

One of their daughters is identified by a deed of gift from John Smith to his daughter “Betsy”. See:

Thicketty Creek and Guilkey Creek area neighbor William  Moorhead witnesses the transaction.

Elizabeth Smith (daughter of John Smith and Nancy Chisholm Smith) is later identified in Lowndes County, Mississippi – married to Drury Gowing b. abt 1805 in a Lowndes County, MS Circuit Court Case – where she identifies her maiden name and the name of her father – John Smith. Also involved in this court case is Abram S. Humphries – son of John Jefferson Humpries – who had married Mary Smith (John Smith’s sister).  See:

Drury B. Goyen (abt 1805-1848) and Elizabeth Smith (abt 1805-1848) have the following children:

    • Nancy Chisholm Goyen – 1840 – 1922 m. Robert Neely Provine (Nancy was named after her grandmother – Nancy Chisholm).
    • (Tax records in Lowndes Co, MS indicate Drury B. Goyen and Elizabeth Smith Going/Goyen had 2-3 other children as well, but so far they have not been identified due to record loss in Pickens Co, AL – where their actual land was located at the time and where they appeared to live prior to 1845).

Drury B. Goyen and Elizabeth Smith Goyen moved to Pickens County, AL some time between 1834-1837 when Drury received 3 land grants in that county. He shows up in adjacent Lowndes County, MS in several records fortunately, as almost all the Pickens County, AL records before the 1870s were destroyed in fires.

Both Drury and Elizabeth appear to have died some time between 1847 and 1848 as they both disappear from all records at that time, and their oldest sons, John E. Going and William W. Going suddenly appear in several records in Lowndes County, MS and Oktibbeha Co, MS (just on the other side of the border from Pickens Co, AL).

Abraham Smith Davis dies in 1859/60 (son of Sarah Smith Davis – sister of John Smith).  William W. Going/Goyen is an admiinistrator of  his great uncle, A S Davis’ estate in Oktibbeha Co, MS.  See:

In the name of God Amen Whereas I Gideon Smith of the State of South Carolina and district of Ninety Six being in a low condition of health and in perfect mind and memory thanks unto God for His mercies and calling to mind the mortality of my body and knowing that it is appointed once for all man kind to die, constitute make and ordain this to be my last will and testament and dispose of all my worldly goods which it has pleased God to Endow me with in manner and form following that is to say principally and first of all I recommend my soul in the hands of God who gave it nothing doubting but at the general resurrection I shall receive the same again My Body I recommend to the Dust from whence I came to be buried in a Christian Decent form at the descretion of my Executors I leave and bequieth and dispose as followeth: I leave unto my beloved wife Jean all my Personal estate after paying all my debts except the land. He died about 1793, perhaps in York County, SC
In the Name of God Amen. I Henry Smith of York County State of South Carolian [sic] being weak in body & much distressed by pain, yet through the Assistance of Divine Providence of sound Judgment of memory. Do make this my last Will of Testament, hereby excluding all others hithertofore made by me. Commending my Soul to God who gave it to be received by him through the merits of Jesus Christ. And my Body to the dust to be decently Buried at the expence of my Executors.
…And first I will that my beloved Wife do hold & possess all my Estate real & personal during her life or widowhood, and then to be disposed of in the following manner.
… And first to my eldest son Abraham I will & Bequeath my second volum [sic] of Pools Anotations [sic]
… To my son David I will the plantation where on I live to Hold the same in Fee Talc. And in case he dieth without heir of his body, to be sold & divided amoungst the rest of my children male & female.

To the honoarable chancellors of the said State.
Humbly complaining shew unto your honors that your orator and oratrix John Smith and Nancy Smith his wife formerly Nancy Chisholm, that in or about the ___ day of ___ in the year of our Lord one thousand eight hundred and ____ Adam Chisholm the father of your oratrix departed this life intestate, being at the term of his death siezed and possessed in fee of a valuable trat of land lying on Pacolet River near to Grindols Shoals which is now in the possession and for time past has been of the dfendants William B Nott and Elizabeth Farnandis and that the said Adam Chisholm at the term of his death left John Chisholm, Obediah Chisholm, Samuel Chisholm, and your oratrix then Nancy Chisholm his heirs at law … that partition and division yet remains to be made of the said land as your orator and oratrix have not as yet received their part of portion of said land and that the Defendants have by some means under claim your orators do not know have been receiving the whole of the rents and profits of said land which is very valuable without accounting in any manner whatever to your orators for that tract of the said rents and profits.
And your orators further shew unto your honors that John Smith the complainant and husband of your oratrix is unfortunately for him either entirely insolvent or nearly so and they are poor and bu a slender means of procuring a support and that the whole of the rest of the fortune of your oratrix which she received from her father’s estate has past into and through the hands of her husband the said John Smith and that he has not as yet made any settlement by any Estate on your oratrix.
The complainants therefore pray that the said land may be partitioned and divided and the share of the said Nancy the complainant settled on her to the use of herself and husband for the — and that the defts may account for rents and profits of the said lands and that the defts may answer this … and that a writ of subpoena issued …. may issue directed the said Defendants William B. Nott and Elizabeth Farnandes and so such other and further relief … compts case may be given and as in duty bound the bill ever pass.

Nott and Elizabeth Farnandez are tenants in common with your orators being in possession under a purchaser or purchasers either directly from someone or more of the heirs at law of the said Adam Chisholm or under them also purchased from them no one having purchased complainants interest as they have never sold or conveyed to anyone, and that said Defendants have been holding as tenants in common with your orators the said premises so that they are clearly entitled to partition and division of the said premises. And your orators pray that the said Defendants may answer this their amended bill as fully and particularly as if the same were herein again repeated and they thereto distinctly interrogated etc.

… these Defendants state that in time that Adam Chisholm died many years ago having the four children enumerated in the will … the Defendant did not know whether he died intestated.
The Defendant Wm B Nott says that his father ___ Nott, under whom he claims, as he is informed bought ___ of the land which he supposes the complts refer to, from the late Henry Farnandis and the Defendant Elizabeth Farnandis states that her late husband, the said Henry, having purchased, claimed the whole of the tract while he held the whole & the half after he divided with Judge Nott, adversely to the claim of the complainants.
The Defendants plead that they and them under whom they claim have had an adverse and ___ possession of the land, example the complainants claims for about ? and claim the complt of the statute of limitations.
The Defendant Wm B Nott states that he is informed by his father, that some years before he bought any part of the land, and while John Chisholme lived on it, he (John Chisholm) offered to sell it to him and showed him a deed which his father Adam Chisholm had made him of it.
And the Defendant Farnandis states, that in the division of her husbands estate, that part of the land in question which he retained was assigned to their daughter Catherine Farnandis now the wife of Jos L Lines as whose guardian Deft held it until her ward attained majority. That the partition of her husbands estate was by ____ in the court of equity in this district, open and public, and no counter claim was put ___ states that some years ago, in her husband’s lifetime, the said complainants as she is informed brought suit against him for the land, which suit they abandoned & let drop & that her husband has been dead now within about 4 months of 6 years.
1829 June 20 … And the said defendants in answer to the complainants amendment, or so much thereof as they are advised is material for them to answer, state that they have never considered themselves as tenants in common with the complainants, but on the contrary they and them under whom they claim have set up an adverse claim to the complainants, as they have stated in their answer to the original bill.
These defendants state, that of their own knowledge they know but little of the case, or the manner of acquiring title by the complainants or them under whom they claim and they therefor require the complainants to make out their case by strict proof. … Defendants insist upon the matters of defense as contained in their original answer which they consider as fully meeting complainants amendment and pray to be dismissed with their costs etc.
