Last Will & Testament – John Gray deceased
In the name of God Amen. I John Gray of the District of Abbeville and State of South Carolina … this my Last Will & Testament …
… it is my will that the tract of land on which I now live be divided into four parts, in the following manner:
… First, by a line starting at a stake corner near my grave yard, and running south 57 degrees west 20 chains, thence making a corner, thence the same course 4 chains, and making a corner, thence the same course until it strikes B H Saxon’s line, then making a corner, then starting at the first corner … on Mrs Norris’ line and near her garden … after the tract of land is divided in the manner above directed I give and beqeath unto my son James that part or division of it that includes my old dwelling house ….
… I give & bequeath unto my daughter Mary that part or division of it which includes the yard, to her and her heirs forever.
… I give and bequeath unto my son Claudius that division or part of it including the dwelling house in which I now live, the well garden & stables to him and his heirs forever.
… I give and bequeath unto my son Joseph that division or part of it which lies next James Gray’s to him & his heirs forever.
… As to my land in the State of Alabama, in Green County, I give & bequeath to my daughter Anna, the remainder of the South West quarter of section No. 5, in Range 5, in Township 20, after taking off 10 acres, already conveyed to my son Allen, to her and her heirs forever.
… And it is my will that the SE quarter of the Section No 5 in Range 5 in Townshi 20, be sold at public auction on a credit of 12 months and the amount of the price thereof equally divided between my 4 children James, Joseph, Mary & Claudius, and I do hererby impower my son Allen or any one of my executors to make a good and lawful title to the purchaser of the last mentioned quarter section of land as soon as the purchase money is made.
… As to my personal estate, it is my will that it be appraised by three menn whom my executor may choose for that purpose, and except my wearing apparel the cash and notes on hand and the negro woman Celia, that it remain on the plantation or heretofore, the use of which together with the use of the plantation, shall be fore the common and equal benefit and suport of my daughter Anna if she remain single, and my minor children, until my son James shall arrive at 21 years of age, at which time I wish it to be sold, with its increase, if any, except the following, my library which I wish to be equally divided among all my children. My wearing apparel which I give to my son James. And the negro woman Celia who I wish to be hired out yearly, until the year 1834 at which time it is my will that she is set free and her issue if any.
… It is my will that my son Lewis receive out of the cash and notes on hand at my decease what further assistance he may need in completing his collegiate course, provided this sum in addition to what he may have before received, as stated in my day book No 5 does not exceed the sum of 800 dollars.
… It is my will that my daughter Patsy receive from time to time out of my estate for her own personal use and benefit as she needs it while her present husband lives, such supplies as my executors may thing proper if she will stay near them and at her present husband’s death, if she has not before recd it, I wish her to receive such sum as may, together with what she shall have before that time recd, as represented in day cash No. 5, and accounts kept by my executors will make 800 dollars, but should she die before her present husband, and leave no issue then it is my will that what may yet be coming of her part of my estate be equally divided among my surviving children.
… As to the remainder of my estate … my will that it be divided between my children Anna, Allen, James, Joseph, Mary & Claudius so as to make them equal …
… I constitute and appoint Alexander Houston Esqr, John Presley, and my sons Allen and James executors of this my last will and testament ..

David I Saunders, admin of Walter Chisholm Sr, decd pltf v Hugh Chisholm, Nimrod R Chisholm, Walter Chisholm, Russell Chisholm, Jane Apperson, who before her marriage was Jane Chisholm, Nancy Hayden who before her marriage was Jane Chisholm, and Sally Chisholm, which said Hugh, Nimbrod R, Walter, Russell, Jane, Nancy and Sally are sons and daughters of the said Walter Chisholm Sr decd, and Catharine Chisholm, the daughter of Catharine Gray, who was Catharine Chisholm, and the children and distributees of Supra Chisholm dec, which said Catharine, last named, and Supra were also children of the said Walter Chisholm Sr decd. Defts.
On the motion of the pltf by counsel Philip B Winston is specially assigned guardian ad litem for the infant defendants, who thereupon filed their answer and the order of publication in this cause, as to the absent defendants having been duly executed, this cause this day came on to be heard on the papers filed, and was argued by counsel: upon consideration whereof the court doth adjudge, order and decree, that David I Saunders, who is appointed a special commissioner for that purpose, do proceed, at the earliest convenient day, to sell at auction the slaves in the bill of the plaintiff mentioned, at Michael R Jones’ Tavern in this county, upon a credit until the falling due of the the bonds formerly taken by him as admin of said decedent (except as to the cost of this suit and to that amount for cash) taking bonds of the purchasers, payable to himself as commissioner as afsd … (continued with advertising by newspaper, etc, for sale).
