In the above difference between Keby and Thomas Evans on behalf of his wife, and Richard Jones on behalf of his wife, a jury was impanelled: Isaac Collier (foreman), William Garven, John Smyth, Robert Curtis, William Bell, Thomas Dunston, Thomas Wardley, John Heyward, Thomas Lloyd, Anthony Melton, Thomas Hansford and Thomas Barbar. 1691/2 March 10: lp Bill of Complaint of Thomas Starke In Virginia in August 1690, Jenkins agreed to buy the Experience Ketch from David Garwin, her master and owner. To pay for the ship, Jenkins drew a bill of exchange on Starke, which was to be paid to Joseph Alford, but not until the ship arrived in England since Jenkins was suspicious of Alford. However, Alford persuaded him to pay on the understanding that if the ship were lost, he would repay Starke. Garwin in fact took the ship to the rebels in Ireland, and she was lost on the coast. Alford now refuses to repay Starke since he pretends that there was no evidence that Garwin acted from his own free will.

He received a letter from Garwin dated franthe James River, enclosing a bill of exchange and a bill of lading. Starke refused to honour the bill until he heard of the safe arrival of the ship. Alford was told of the safe arrival on the Exchange soon afterwards and Starke, therefore, agreed to pay him with the understanding that he would be repaid if it was proved that Garwin was responsible for any loss of the ship. Later Garwin told him that the ship had been forced into the Irish coast by bad weather and lost. The cargo was seized by the rebels and the crew badly treated. 1692 March 28: Thomas Starke c. Henry Jenkins and Joseph Alford [See C 9/121/7; C 33/278] lp Answers of Henry Jenkins to the Bill of Complaint of Thomas Starke
March 28, 1692. Agrees that he bought the Experience Ketch from David Garwin as is alleged. He paid by a Bill of Exchange drawn on Starke and asked the latter not to pay until he had received delivery of the ship. Does not know what agreement Starke had with Joseph Alford who was acting for Garwin but if Starke paid the money it was not with the defendant’s consent and he therefore refuses to pay the plaintiff. Garwin caused the ship and her cargo to be lost off the Irish Coast and Starke has approached the defendant several times for money since his return from Virginia. Court of Chancery.
